The work “Online Secrecy, Criminal Investigations and International Cooperation” results from the application made by the Internet and Society Reference Institute for its admission as ‘Amicus Curiae’, as well as the memorial presented in this condition, with a view to assisting the Federal Supreme Court in Consideration of the Declaratory Constitutionality Action (ADC) no. 51, filed by the Federation of Associations of Information Technology Companies – Assespro Nacional.
The Action seeks to examine the relevance of Decree 3.810 / 2001, Article 237, II of the Code of Civil Procedure and Articles 780 and 783 of the Criminal Procedure Code, in particular as regards international legal cooperation for data collection measures. private communication between users of internet applications, directed to business companies headquartered and established abroad.
