A legal framework for startups in Minas Gerais

During the first semester of 2016, the Legislative Assembly of the State of Minas Gerais (ALMG) began debating a Public Policy proposal to foster the Startup ecosystem in the state through the draft Bill No 3.578/2016, whose authors are Deputies Antônio Carlos Arantes (PSDB) and Dalmo Ribeiro (PSDB). Currently, the bill is pending approval by the Commission of Constitution and Justice of the ALMG.

Since May 2016, three public meetings took place to discuss the bill, with contributions from members of IRIS, of entrepreneurs from Belo Horizonte, representatives of the BH-Tec Technological Park and the president of the Israel-Brazil Chamber of Commerce. Developing public policies is a complex process. All of its phases must be open to contributions from citizens, fostering the accomplishment of a more direct democracy.

Aware of such aspects, the Institute for Research on Internet and Society, along with its Cyberlaw Clinic, has contributed to the development of this public policy through the critical application of knowledge developed within the Federal University of Minas Gerais.

On the 4th of July, an analysis of the bill was presented to deputies, which considered conceptual and tax aspects, the need for wider representation on discussions, the importance of optimizing incentives and investments, the viability of creating a startup observatory, the importance of education in entrepreneurship in the State as well as ways of promoting the internationalization of Startups in Minas Gerais. Lucas Anjos, lawyer, and Odélio Porto, bachelor in law, both presented the report to the work group at the ALMG.

On the same meeting, it has been decided that interested entrepreneurs, members of IRIS and Bh-Tec, along with the General Project Management of the Assembly will together promote a Cycle of Debates about the Bill, of public nature, to take place in September 2016. This initiative seeks to achieve a multistakeholder and higher representative bill, so that many diverse sectors affected by the proposal, such as the government, civil society, education institutions and entrepreneurs might contribute with their own experience and specific views.

IRIS would then like to invite all those interested to follow the development of the discussions about the bill through or site or through the ALMG portal. A new meeting has been scheduled for the 18th of July.
